ECTA Membership and Data

An ECTA Membership will hold and process personal data in the context of ECTA membership for the following purposes:

  • Managing your company’s ECTA membership
  • Managing access to our website and member services
  • Giving ECTA members’ access to each other’s basic contact data
  •  Sending you information we believe may be of interest to you based on your company profile or the interests you have communicated to us
  •  Seeking information about you, your company and your views on what priorities and services you would like us to provide
  • The lawful basis for processing your data is within the legitimate interests of ECTA and in line with our non-profit mission “to improve the standards of efficiency, safety, and security as well as the environmental and social impacts of the transport and logistics of chemical goods in Europe”

Project implementation ECTA will hold and process data of representatives of members of ECTA and of persons involved in other projects in order to achieve the shared objectives of the projects and the ECTA mission. ECTA will also hold and process data of persons who apply to take part in ECTA activities such as the Responsible Care workshop, the ECTA Annual Meeting, working groups & issue teams, networks of experts and/or any other ECTA supported projects. In all cases, we believe that there is a contractual basis for processing such personal data.

a) Membership

If a company is an ECTA member, it is published on our website and viewable for all users. Data that is published is Company’s name, website and Responsible Care Membership. The aims of this publishing are transparency, as well as networking.

b) Executive Committee/Board of Directors/Committees/Working Groups/Team

If a person is part of one of this groups, its name, company, country, picture and role within ECTA is published on this website and viewable for all users.

All media on this website are copyrighted and are neither allowed to be downloaded, copied nor shared.

events

If a person registers to an ECTA event, all given data while the registration is stored within our database. Other Data than the name and company will not be forwarded to third parties. Names and Company will only be forwarded to Event location for managing the Event package like table reservation. For physical Events the name and company will be printed in order to give the person access to network.

Stored email addresses will be used to contact the registrant before, while and after the Event. Stored invoice details will be stored in order to manage the invoicing process properly. This data is forwarded to our accountant for managing the invoicing process.

For online Events, the stored email address will be used to send out the Link for the meeting.

3. What is personal data?

Personal data is defined by the by the General Data Protection Regulation (EU Regulation 2016/679) (the “GDPR”) as ‘any information relating to an identifiable person who can be directly or indirectly identified in particular by reference to an identifier’. Personal data is, in simpler terms, any information about you that enables you to be identified. Personal data covers obvious information such as your name and contact details, but it also covers less obvious information such as identification numbers, electronic location data, and other online identifiers.

4. What are my rights?

Under the GDPR, you have the following rights, which we will always work to uphold:

  5. The right to restrict (i.e. prevent) the processing of your personal data. You have the right to ask us to restrict the use of your personal data if (i) you believe that the personal data which we hold is inaccurate, (ii) if we are processing the personal data unlawfully, (iii) you have objected to us processing your personal data for our legitimate interests or (iv) we no longer need the personal data for the purposes of processing but you want us to keep this for the establishment, exercise or defence of legal claims.
  6. The right to object to us using your personal data for a particular purpose or purposes. If you make such an objection, we will cease to process the personal information unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing is for the establishment, exercise or defence of legal claims.
  7. The right to data portability. This means that, if you have provided personal data to us directly, we are using it with your consent or for the performance of a contract, and that data is processed using automated means, you can ask us for a copy of that personal data to re-use with another service or business in a structured, commonly used and machine readable format. However, this right does not apply where it would adversely affect the rights and freedoms of others.
  8. Rights relating to automated decision-making and profiling. You have the right not to be subject to decisions which may legally or significantly affect you and that were based solely on automated processing using your personal data. We will however not use your personal data in this way.

There is in principle no charge for exercising your right. If, however, your request is ‘manifestly unfounded or excessive’ (for example, if you make repetitive requests) a fee may be charged to cover our administrative costs in responding.

We will respond to your request within one month after receiving it. Normally, we aim to provide a complete response, including a copy of your personal data within that time. In some cases, however, particularly if your request is more complex, more time may be required up to a maximum of three months from the date we receive your request. You will be kept fully informed of our progress.

If you consider that our processing of your personal information infringes data protection laws, you have a legal right to lodge a complaint with a supervisory authority responsible for data protection. We may process your name, contact information, connected ECTA Partner (“account data“).The source of the account data is you. The account data may be processed providing our services, ensuring the security of our website and services, maintaining back-ups of our databases and communicating with you. The legal basis for this processing is the performance of a contract between you and us and/or taking steps, at your request, to enter into such a contract.

Correspondence data

We may process information contained in or relating to any communication that you send to us (“correspondence data“). The correspondence data may include the communication content and metadata associated with the communication. The correspondence data may be processed for the purposes of communicating with you and record-keeping. The legal basis for this processing is our legitimate interests, namely the proper administration of our website and business and communications with users.

We may process any of your personal data identified in this Privacy Notice where necessary for the establishment, exercise or defence of legal claims, whether in court proceedings or in an administrative or out-of-court procedure. The legal basis is our legitimate interests, namely the protection and assertion of our legal rights, your legal rights and the legal rights of others.

Internal access to the personal data is limited on a strict ‘need-to-know’ basis. Only authorized personnel, whose activity will be monitored to prevent any misuse, will be able to access the personal data.

Our website targeted at persons over the age of 18. If we have reason to believe that we hold personal data of a person under that age in our databases, we will delete that personal data.
